This website is operated by La Marina Co. Throughout the site, the terms “we”, “us” and “our” refer to La Marina Co. La Marina Co offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies available to you on our website (lamarinaco.com). By agreeing to these Terms of Service, you represent that you have the legal capacity and are of sufficient age to enter into a binding contract with us. These Terms apply to all site users, including but not limited to, browsers, customers, and contributors of content.


We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. Section 2 - Submitting an Order

By submitting an order for purchase of a Product using the Website’s functionality (Order) you represent and warrant that:

    • you have the legal capacity and are of sufficient age to enter into a binding contract with us; and
    • you are authorised to use the debit or credit card you provide with your Order

Submitting an Order constitutes your intention and offer to enter into these terms, where we will provide you with the Products you have ordered in exchange for your payment of the total amount listed upon checkout.

Section 3 - Products

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy.

  • minor variations and risk
    • We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. Please note that due to screen display, colour, brightness and image quality Products may not exactly match the image displayed on our website.
    • Until the price of your Products is paid in full, title in those Products is retained by La Marina Co. Risk in the Products will pass to you on delivery in accordance with the section 5 of this policy. Delivery must not be refused by you.
  • vouchers and discount codes
    • We may provide promotional materials and discount codes offering a discount on the Products (Voucher). To use a Voucher, you will need to enter its code at checkout.
    • A Voucher can only be applied at the time of placing and Order and not retrospectively to an Order. Vouchers are non-transferrable and cannot be redeemed for cash or store credit.
    • If any additional terms or conditions apply to the Voucher, these will be set out on the Voucher.

    • prices for our products are subject to change without notice.
    • We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
    • We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

We reserve the right to limit the sales of our Products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

Section 4 - Payment

  • All prices are:
    • per unit (except where indicated);
    • in Australian Dollars; and
    • subject to change prior to you completing an Order without notice.

  • (Payment obligations) Unless otherwise agreed in writing, you must pay for all Products at the time of placing an Order.

  • (Card surcharges) All For Mimi reserves the right to charge credit card surcharges in the event that payments are made using a credit, debit or charge card (including Visa, MasterCard or American Express).

  • (Online Payment Providers) We may use third-party payment providers to collect payments for Products, such as Paypal, Afterpay and Shop Pay. The processing of payments by the Payment Provider will be, in addition to these terms, subject to the terms, conditions and privacy policies of the Payment Provider and we are not liable for the security or performance of the Payment Provider. We reserve the right to correct, or to instruct our Payment Provider to correct, any errors or mistakes in collecting your payment.

Section 5 - Shipping

  • (Delivery Costs) Delivery costs will be added to the cart upon checkout. The prices displayed at checkout are inclusive of delivery to the address chosen by you.
  • We may ship our Products with any delivery service provider we deem appropriate. Third party courier terms apply to the delivery of the Products to you. 
  • (Delivery Issues) Any problems with delivery should be directed to us to troubleshoot the issue. All delivery times are an estimate and are subject to change based on delays and reasons beyond our control. We will not be liable for any loss or damage endured as a result of or in connection with late deliveries. Any issues, please contact info@lamarinaco.com and we will endeavour to resolve the issue if possible.
  • (Delivery Times) Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for delays caused by shipping carriers or customs
  • (International Orders) La Marino Co reserves the right to refuse international orders. 

Section 6 - Changes to Orders

  • Cancellation by Us
    • La Marina Co reserves the right to cancel your order for any reason, any will endeavour to notify you as soon as possible.
    • Where payment has already been debited, the full amount will be reimbursed to your original payment method.
  • Cancellation by You
    • You may cancel your Order up to the time that we confirm your Order in writing to you. Once your Order is confirmed, it cannot be changed be you. Please refer to our refunds and exchanged policy for more information on further action. 

Section 7 - Returns & Exchanges

  • Change of Mind
    • La Marina Co does not offer returns on change of mind products. If you require a return, please contact us at info@lamarinaco.com and we will investigate the request. 
  • Faulty/Defective Products
    • La Marina Co will provide a full refund of the price paid for the Product if we deem the Product ordered was not received solely due to failure by us; or, the Product provided was not substantially the same as the Product ordered via our website (subject to variation as per Section 3); or, the Product is defective (in accordance with Section 8). 
    • Alternatively, La Marina Co may provide a store credit or replacement as an alternative resolution to these issues.

Section 8 - Defective Products

If you believe your Product is defective, please contact us at info@lamarinaco.com with your issue (including images and a full description) within 14 days of receiving the Product. 

La Marina Co will assess the issue and evaluate the defect. If we determine that the Product is defective, we will request the Product to be sent back to us at your own cost for further inspection. La Marina Co reserves the right to inspect a Product prior to deeming it defective. 

  • (Deemed Defective) If La Marina Co deems a product defective, we will issue you a store credit, a replacement or a full refund (including shipping costs), depending on the nature of the defect. All refunds will be credited to your original payment method, unless stated otherwise and approved by us.
  • (Not Deemed Defective) If La Marina Co deems a Product is not defective, or is defective due to failure to take reasonable care, follow instructions or general wear and tear, La Marina Co will refuse the request and send the Product back to you, at your own cost. 

This section is not intended to limit or affect the operation of manufacturing warranties that may be applicable or any of your rights which cannot be excluded under applicable law.

Section 9 - Third Party Suppliers

La Marina Co reserves the right to engage in the following activities:

  • outsource any part of activities related to providing our Products, including the delivery of your Product; and/or
  • procure materials and Products from third party suppliers

Certain content, products and Services available via our Service may include materials from third-parties. You acknowledge that Third Party terms may apply, and agree to any Third Party Terms applicable. La Marina Co will not be liable for any acts or omissions of those third parties, including where third party providers cause delay or damage to your Order, or are negligent in providing goods or services. 

Section 10 - Intellectual Property

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Product or Service, use of the Product or Service, or access to the Service or any contact on the website through which the Service is provided.

Section 11 - Limitation of Liability

To the fullest extent permitted by law, La Marina Co. shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of our services or products. 

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. You expressly agree that your use of, or inability to use, the Product or Service is at your sole risk

In no case shall La Marina Co, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Our liability shall be limited to the maximum extent permitted by law.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). 
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.
